1. Acceptance of terms
These Terms of Service ("Terms") form a binding agreement between you and Anana Fertility ("Anana," "we," "our," or "us") governing your use of the Anana Fertility mobile application and related services (the "Service").
2. Eligibility
You must be at least 18 years old to use Anana Fertility. By using the Service, you confirm that you meet this requirement and that the information you provide is accurate.
3. Not medical advice
Anana Fertility is a tracking and organization tool. It does not provide medical advice, diagnosis, or treatment, and is not a substitute for professional care. The medication scanning feature is provided for convenience and may contain errors — always verify medication details with your prescriber or pharmacist. Never disregard professional medical advice because of something in the app.
In a medical emergency, call your local emergency number immediately. Always consult your fertility clinic or physician about your treatment.
4. Your account
You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly of any unauthorized use. You agree to provide accurate information and to keep it up to date.
5. Subscriptions & billing
Some features require a paid subscription, processed through the Apple App Store or Google Play and managed via our billing provider, Adapty. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription through your app store account settings. Except where required by law, payments are non-refundable. Refund requests for app store purchases are handled under the respective store's policies.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Attempt to access, disrupt, or reverse-engineer the Service or its systems.
- Upload malicious code or interfere with other users.
- Resell, copy, or commercially exploit the Service without our permission.
7. Intellectual property
The Service, including its design, logo, and content, is owned by Anana Fertility and protected by intellectual property laws. You retain ownership of the data and content you enter. By using the Service, you grant us a limited license to process your content solely to operate and provide the Service to you.
8. Third-party services
The Service relies on third-party providers including Supabase (hosting), Google Gemini and OpenAI (medication scanning), Google Maps (locations), and Adapty (billing). Your use of features powered by these providers may also be subject to their terms. We are not responsible for the practices of third-party services beyond our agreements with them. 9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or use the Service in a way that risks harm to others or to the Service. On termination, your data is handled as described in our Privacy Policy.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that the medication scanning feature will be fully accurate.
11. Limitation of liability
To the fullest extent permitted by law, Anana Fertility will not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of or inability to use the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.
12. Governing law
These Terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Wisconsin, unless applicable law requires otherwise.
13. Changes to these terms
We may update these Terms from time to time. We will notify you of meaningful changes before they take effect. Continued use of the Service after changes means you accept the updated Terms.
